Hunton Andrews Kurth Client Alert

In recent years, receivers and bankruptcy trustees have sought to recover losses from banks and large businesses—who may be viewed as “deep pockets” for potential recoveries—based on evolving legal theories. Pursuant to one of these theories, trustees and receivers increasingly have alleged that routine banking activities can give rise to fraudulent conveyance liability—in many cases seeking to recover every single deposit made by a distressed entity into its own accounts at one or more financial institutions. A recent published decision from the United States Court of Appeals for the Eleventh Circuit, Isaiah v. JPMorgan Chase Bank, 960 F.3d 1296 (11th Cir. 2020), soundly rejected the notion that deposits and withdrawals from an ordinary deposit account constitute fraudulent transfers to the bank, and held that receivers lack standing to assert tort claims that the receivership entities would not be able to pursue.

National Democratic Redistricting Committee

This upcoming election is an existential one. The current administration is dangerous and divisive, and must be replaced with new leadership. But we can't stop at winning the White House.

The fact is that this election will impact the next decade by determining who will draw the maps for state legislative and U.S. House districts next year. And if we fall short, the consequences will ripple across our democracy. Unresponsive legislators elected from unrepresentative districts will tighten their grip on power with continued voter suppression. They will stand with the special interests -- and not the people.

That's why there is so much urgency to our work right now, Sula. The NDRC is committed to protecting our elections and winning key races in our target states. But we need your help. If you're with us, can you make a donation today?

We've made significant progress since the NDRC launched in 2017, but this year is our last chance to defeat map manipulators ahead of redistricting in 2021. And it's coming at a time when there is a renewed push from politicians who are putting their voter suppression efforts into overdrive.

We saw it in Wisconsin, where conservatives refused to recognize the danger presented by the public health crisis and attempted to halt all efforts to allow expanded mail-in voting. And we saw it just recently in Georgia, where closed polling locations and enormous lines prevented voters from exercising their right to cast a ballot in a healthy environment.

We have our work cut out for us, and we're counting on your support to get it done. Will you make a donation to help the NDRC simultaneously fight voter suppression and win in all of our target states this November? The future of our democracy rests with you.
